Clear terms. No ambushes.

These Terms of Service (“Terms”) are an agreement between you and the independent sole proprietor operating the Beak software service under the Beak brand (“Beak,” “we,” or “us”). The supplier identity verified by Paddle is also shown during checkout and on your receipt.

By using Beak, you confirm that you can enter this agreement and accept these Terms, the Privacy Policy, and any in-product rules that clearly apply to a feature. If you buy Beak Pro, the Refund Policy also forms part of this agreement.

Beak is a desktop and web service that can transcribe microphone and computer audio, detect questions, retrieve context you provide, analyze a screenshot you deliberately share, and generate concise AI-assisted suggestions during calls, meetings, and interviews.

• AI output can be wrong. It may be incomplete, outdated, unsuitable, or sound confident when uncertain. Review it before speaking, sending, or relying on it.
• You remain the decision-maker. Beak does not give legal, medical, financial, tax, employment, or other regulated professional advice.
• Be truthful. Beak is designed to help you recall and communicate your own experience—not invent qualifications, employers, results, or facts.
• Third-party platforms set their own rules. A meeting host, employer, school, test provider, or workplace may prohibit transcription, recording, or AI help.

• You must be at least 18 and legally able to enter a contract.
• Provide accurate information and keep your account email current.
• Protect your password, authenticated devices, and desktop sign-in link.
• Do not share, sell, or transfer an account or let another person evade their limits through it.
• Tell us promptly at [email protected] if you suspect unauthorized access.

You are responsible for activity performed through your account until you notify us of suspected compromise, except to the extent applicable law places responsibility elsewhere. We may require verification before changing sensitive account details.

You may not use Beak to:

• break a law, court order, contract, duty of confidence, or another person’s rights;
• record or transcribe a person without legally sufficient notice or consent;
• impersonate someone, fabricate credentials, deceive an interviewer, or violate a test or assessment rule;
• harass, stalk, discriminate against, exploit, or facilitate harm to another person;
• upload malware, unlawfully obtained data, or content you have no right to process;
• probe, reverse engineer, scrape, disrupt, overload, or bypass Beak’s security, billing, quota, or access controls;
• resell, sublicense, provide timeshared access to, or build a competing dataset or service from Beak without written permission;
• use automated means to create accounts, consume the service, or evade enforcement.

We may investigate suspected misuse using proportionate account and operational records. We will not monitor private session content routinely for general surveillance.

• Unused minutes or hours do not roll over, transfer, or convert to cash.
• Usage is measured from server-authoritative live-session activity, including a short bounded grace interval needed to close an interrupted session safely.
• Only one live session may consume an account’s allowance at a time.
• Beak does not automatically charge overage or continue paid usage beyond the included balance.
• Additional paid time is not currently sold. If introduced, its price and expiry will be shown before purchase.

We may apply reasonable technical, safety, and anti-abuse limits that do not materially reduce the purchased core allowance. A plan or price change applies prospectively; we will give notice before materially changing an existing paid subscription where required.

• Merchant of Record. Paddle is the seller of record, processes your payment and applicable transaction taxes, and issues the receipt or invoice.
• Automatic renewal. Beak Pro renews monthly until canceled. By subscribing, you authorize Paddle to charge the payment method on file for each renewal.
• Cancellation.Cancel at any time from Beak’s Subscription page, the secure Paddle customer portal, the link in your receipt, or Paddle buyer support. Cancellation normally takes effect at the end of the current paid period. It stops the next renewal; it does not automatically refund the current or already used period.
• Failed payment. Paddle may retry a failed renewal. Beak may provide a limited grace period, then suspend paid access if the subscription becomes paused or canceled.
• Refunds. Requests follow our Refund Policy, Paddle’s policy, and any mandatory rights that give you greater protection.

A scheduled cancellation does not end access early. Your paid access normally continues until the subscription status actually becomes canceled, unless a refund, fraud finding, legal requirement, or serious breach requires earlier suspension.

You retain rights in résumés, documents, prompts, transcripts, screenshots, and other content you lawfully provide (“Your Content”). You give Beak a limited, worldwide, non-exclusive license to host, copy, transmit, transform, and display Your Content only as needed to provide, secure, troubleshoot, and support the service under these Terms and the Privacy Policy.

You represent that you have the rights and permissions needed for Your Content and its processing. You are responsible for reviewing AI-generated output before using it and for whether that use infringes another person’s rights.

Beak’s software, service design, interfaces, documentation, trademarks, and underlying technology remain owned by Beak or its licensors. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the available Beak software for its intended purpose.

We work to provide a reliable service but do not guarantee that Beak will always be available, error-free, compatible with every device or meeting platform, or able to produce a useful answer. Maintenance, provider outages, security work, legal restrictions, and events outside reasonable control may interrupt access.

We may improve, replace, or discontinue features. If a change materially removes the core paid service during your current period, we will provide a reasonable remedy, which may include continued access, a workaround, cancellation, or an appropriate refund.

Links and integrations may be governed by third-party terms. Beak is not responsible for third-party services except to the extent law says otherwise or the failure is caused by Beak’s own breach.

• You may stop using Beak at any time and cancel Pro to prevent future renewal.
• You may delete your account through the account page; primary product records are removed as described in the Privacy Policy.
• We may limit or suspend access to address security, nonpayment, fraud, legal requirements, or a material breach.
• Where appropriate, we will provide notice and a reasonable chance to fix a remediable breach.
• We may act immediately where delay could cause harm, compromise an investigation, or violate law or provider requirements.

Ending the service does not erase payment obligations already incurred. Sections that logically must continue—including ownership, payment, disclaimers, liability, disputes, and lawful record retention—survive termination.

To the maximum extent permitted by law, Beak is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee an interview outcome, employment decision, meeting result, transcription accuracy, or the correctness of AI output.

To the maximum extent permitted by law, Beak is not liable for indirect, incidental, special, exemplary, or consequential losses; lost profits, opportunities, goodwill, or data; or losses caused by relying on unverified output, failing to obtain participant consent, or violating a third-party rule.

Beak’s aggregate liability arising from a paid account is limited to the greater of (a) the amount paid for Beak during the three months before the event giving rise to the claim or (b) USD 50. For a Free account, the aggregate limit is USD 50.

These Terms and the Beak product relationship are governed by the laws applicable at Beak’s principal place of business, without regard to conflict-of-law rules. This does not remove mandatory consumer rights or a right to bring a claim in another forum where applicable law requires it. Paddle’s Buyer Terms separately govern the payment relationship and identify its governing law.

Before filing a formal claim, please email a clear description and requested resolution. We will try in good faith to resolve the issue within 30 days. Either party may seek urgent relief where necessary to protect security, confidentiality, or intellectual property.

We may update these Terms for legal, security, provider, or product reasons. We will date the new version and provide advance notice of a material adverse change where required. Continuing to use Beak after the effective date means the updated Terms apply, except where law requires express consent.
